Outback murder case goes to supreme court

A judge Monday threw out the murder charge against a man accused of killing a man and his mother with a shotgun after a jury concluded it was not proven his hands were tied by a "strict legal standard."

Cyrus Hogg's lawyer argued the murder charge was based on evidence provided by an ex-spouse, but U.S. District Judge Charles Breyer disagreed, and concluded there was no evidence to support it and a criminal trial would be premature.

"Mr. Hogg is innocent. There is not sufficient evidence to support this felony charge. Mr. Hogg is certainly entitled to a fair trial," Breyer wrote.

Prosecutors had asked for the conviction to be tossed because they had no proof of Hogg's handiwork.

Prosecutors said Hogg killed his parents with an illegal weapon. An autopsy on Hogg found that one of his hands was bloody, the other missing fingers, and one bullet hole was deep in one of his chest.

One of the bullets entered a lung, the state said, which was connected to a heart. It ruled that Hogg used a shotgun that had "defaced the victim's corpse in several places" with the "excessality to cause the victim's death," and to cause it quickly and deliberately.

But Hogg's lawyers countered that his father died with dignity and showed a lack of concern for his life when Hogg allegedly shot the man who had just arrived on his property from work to help him clean out its trash.

The family's medical examiner, Dr. James DeFazio, also disputed the family's version of the case, saying he couldn't confirm the wounds from the shotgun had "an explosive yield" in the first place.

That made it impossible to see how the gun could have come "from such a violent use" of force, DeFazio wrote in his report.

However, DeFazio did note Hogg had told investigators he shot his father in self-defense — something not presented in the state's case — and concluded Hogg's handiwork had already been found.

That's because when the shooting began, Hogg's body did not seem to be in danger and the gun would have "muddy blood that would reveal its existence."

Also, because Hogg was not in the house when his father died, the evidence the state presented would not have been sufficient to find him guilty, the attorney for the Hogg family wrote.

The death count was dismissed as "out of further consideration of the evidence."
